According to the Centre, a new draught telecommunications bill will soon include a legal framework for the interception of over-the-top communication services like WhatsApp, Signal, and others. The industry that depends on the security and privacy of encrypted messages will be significantly impacted if the bill is put into effect in its current form. Broadcasting services, electronic mail, voice mail, voice, video, and data communication services, audiotex services, videotex services, fixed and mobile services, internet and broadband services, and satellite-based communication services are all considered telecommunication services, according to the bill.
A study by HT said that it also includes over-the-top (OTT) communication services, in-flight and maritime connectivity services, interpersonal communications services, machine to machine communications services, and internet-based communication services. If the government declares certain services to be telecommunication services, then additional services may be introduced. The Center has also polled the populace about this. Additionally, phone and video calls made using these applications will be intercepted.

According to section 24 of the draught, “on the occurrence of any public emergency or in the interest of the public safety” the central and state governments, or any officer particularly authorised in this regard by the national or a state government — direct that any message or class of messages, to or from any person or class of people received by any telecommunication services… shall not be transmitted, or shall be intercepted, detained, or disclosed, for reasons to be recorded in writing, if it is satisfied that doing so is necessary or expedient in the interest of the sovereignty, integrity, or security of India, friendly relations with foreign states, public order, or preventing incitement to an offence.
