The Competition Commission of India (CCI), defending its decision to look into WhatsApp, said the Delhi High Court on Monday that the messenger service has not changed its privacy policy from 2021. The CCI maintained the scope of its investigation has no overlap with the matter of an alleged violation of user privacy that is currently before the Supreme Court in order to get the HC’s approval to move forward with the investigation undisturbed. However, the sole judge had declined to halt the probe on April 22 of last year. The CCI defended its decision to look into WhatsApp’s privacy policy together with its parent company Facebook, claiming that the latter is the holding company for the messaging service and may “possibly exploit the data being exchanged.” According to WhatsApp’s legal representative, the “status quo” is being preserved for users who have not chosen to adjust their privacy settings, and the CCI investigation should be postponed given that the privacy setting is now being upheld by the Supreme Court and the high court.

In a submission made last week, senior attorney Harish Salve on behalf of WhatsApp said:

The company was contesting the CCI’s authority to look into a policy that had been put on hold while the government was introducing the Data Protection Bill. For Facebook Inc. (formerly Meta Platforms), senior attorney MukulRohatgi had contended that there was not even initial evidence to support the lawsuit.
