Is Mass Lay Off Considered Illegal??? Know What Minister Said About This!!! Layoffs from tech companies to EDEtech and eCommerce companies have been the hot talk across the world. Unexpectedly, this rate of layoffs has affected employees from small companies to large corporations. Some of these layoffs were announced as formal notices.
However, some companies were taking drastic action by dismissing employees without any prior notice. Labor and Employment Minister Bhupender Yadav has said that if the employees are not dismissed as per the Industrial Disputes Act, it will be considered illegal. Regarding this, he said that matters related to dismissal in industrial establishments come under the provisions of the Industrial Disputes Act, 1947 (IT Act).
According to this Act, companies with about 100 or more employees must obtain permission from the appropriate government before being sacked. Also, the companies have to pay the right of the laidoff employees as compensation. Otherwise, it will be considered illegal.
